STANDARD TERMS & CONDITIONS OF SALE
These Terms and Conditions shall apply unless otherwise specifically agreed in writing by both parties. No contracts are entered into by us except upon these terms.
These Terms and Conditions override any Purchaser's Conditions and the fact that the Purchaser has accepted our Tender deems to invalidate his Conditions of Purchase.
All prices are strictly nett, subject to VAT at 20% and prices are subject to alteration without notice.
- Carriage and Packing
Carriage and packing charges are included within the sale price for UK customers. For international deliverys please email for enquiries.
Payments must be made and cleared before any goods are dispatched and credit accounts won’t be allowed.
We will endeavour to despatch all orders within the time specified but we cannot guarantee the date of despatch nor assume responsibility for loss resulting from delay from any cause whatsoever. Any times quoted for despatch are to date from receipt by the vendor of a written order to commence and of all necessary information. We reserve the right to deliver in more than one shipment at our discretion.
Cancellations of orders will not be accepted unless notified in writing prior to us sending out the parts and we reserve the right to make a cancellation charge based on the expenses involved in handling the order to date of cancellation.
We offer three months warranty on our products from the date of dispatch but we must be made aware of the problems prior to returning the items to us and there must be a valid reason to return the product, i.e. dead on arrival or faulty. If you would like to return a product please contact us for an RMA. Note the return postage must be paid by yourself unless agreed otherwise, we also reserve the rights to either credit you a refund of the initial payment or send out a replacement item if one is available.
- Technical Data
Whilst every effort is made to ensure the accuracy of technical data & part descriptions given, we cannot accept liability in respect of any contingency arising from errors or omissions.
We cannot be held liable for any costs incurred or consequential loss or damage due to faulty equipment supplied by us, or as a result of any service performed by bms-systems.
- Faulty Goods
No liability can be accepted for components whose performance does not meet the data sheet specification, which are dead on arrival, or otherwise faulty, until such time as a written assessment has been received after thorough testing. Faulty goods must be returned within thirty days of the date of despatch but you must agree the return via bms-systems prior to returning any faulty components. bms-systems reserves the rights to not accept returns of faulty items.
- Incorrectly Ordered Goods
No liability whatsoever can be accepted for incorrectly ordered goods.
Damage caused in transit must be notified in writing within three days of receipt, failing which no liability will be accepted. The original packaging must be retained and produced for inspection.
In the event of non-delivery, no claim can be entertained unless we are informed in writing within eight days of the date of delivery.
We always try and ensure our stock list is up to date but in the event a product is purchased which doesn’t exist in our stock or is found to be damaged we will refund the full amount of money paid and will apologise for the mistake.
English Law will apply to all disputes.
